The latest lawsuit aimed at stalling development plans at Arizona Snowbow has been shot down by a federal appeals court.
A ruling today says the group Save the Peaks Coalition and private citizens who filed the lawsuite grossly abused the judicial process.
Today’s ruling upholds a previous decision by a lower court which said the U.S. Forest Service adequately evaluated the effects of snowmaking using treated wastewater.
The court said the latest appeal is a delay tactic, designed to prevent Arizona Snowbowl from moving forward with snowmaking.
