Arizona Snowbowl has won yet another legal battle, although the Save the Peaks Coalition is promising to appeal today's decision. Judge Mary H. Murguia ruled against the plaintiffs, who were claiming the final environmental impact statement by the U.S. Forest Service ignored health issues.
Arizona Snowbowl is planning snowmaking operations at the resort near Flagstaff using reclaimed wastewater.
Snowbowl officials told Flagstaff Business News that plans are in place to build a pipeline to carry water from Flagstaff to the ski resort and construction will begin as soon as the legal challenges are cleared.
Howard Shanker, representing the Save the Peaks Coalition and additional plaintiffs, will file an appeal to the Ninth Circuit Court. According to Shanker, “ the decision misstates the facts of this case and misapplies the law. That’s why there is an appeal process.”
